PLEASE NOTE THAT YOUR PARTICIPATION IN THE PROMOTION IS SUBJECT TO THE FOLLOWING TERMS & CONDITIONS. IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT PARTICIPATE IN THE PROMOTION IN ANY MANNER. PARTICIPANTS IN THE PROMOTION MUST REGISTER AND MAINTAIN AN ACCOUNT WITH UNDERDOG. COLLECTIVELY, “UNDERDOG” REFERS TO UNDERDOG SPORTS HOLDINGS, INC., ITS SUBSIDIARIES AND AFFILIATED ENTITIES, INCLUDING, BUT NOT LIMITED TO, UNDERDOG SPORTS, LLC D/B/A UNDERDOG FANTASY; UDM, LLC D/B/A UNDERDOG PREDICT; AND UDM SERVICES, LLC. UNDERDOG PROVIDES AN ONLINE PLATFORM VIA ITS UNDERDOG APP (WHETHER ON ANDROID, IOS, OR OTHERWISE) AND MAY ALSO OFFER THE PLATFORM THROUGH A WEBSITE (COLLECTIVELY, THE “SITE”). PARTICIPANTS IN THE PROMOTION MUST ALSO ACCEPT THE UNDERDOG FANTASY & UNDERDOG PREDICT TERMS OF USE (“TERMS”), WHICH IN TURN INCORPORATE AND APPLY TO THESE OFFICIAL RULES. THESE OFFICIAL RULES GOVERN AND CONTROL THE PROMOTION AND ARE CONSIDERED TO BE PART OF THE TERMS. PLEASE NOTE THAT THESE RULES EXPRESSLY INCORPORATE MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS SET FORTH IN THE TERMS. THE COLLECTION AND PROCESSING OF PERSONAL INFORMATION AS PART OF OR IN CONNECTION WITH PARTICIPATING IN ANY PROMOTION, INCLUDING THIS ONE, ARE SUBJECT TO AND GOVERNED BY THE UNDERDOG FANTASY & UNDERDOG PREDICT PRIVACY POLICIES.

1. Description of Promotion
Welcome to the Play and Get Promotion (“Promotion”) where eligible participants who place an “Eligible Entry” as defined in the “Promotion Advertisement” during the “Promotion Period” (such terms defined below) will receive Bonus Funds and/or Bonus Entries available for use only on the Site equal to the amount conspicuously stated in the Promotion Advertisement provided to you (“Promotion Bonus”).
BONUS FUNDS AND BONUS ENTRIES ARE NOT EQUIVALENT TO CASH DEPOSITS. The Promotion Bonus is subject to turnover or playthrough requirements, time limitations, and other limitations detailed in these Official Rules.
2. Sponsor
The Promotion is sponsored by Underdog (“Sponsor”). The terms “you” or “your” mean the person to whom a Promotion Bonus is issued upon satisfaction of the terms and conditions set forth in this Promotion. Redemption of the Promotion is expressly conditioned upon acceptance of and compliance with all these Promotion Terms and Conditions (“Terms and Conditions”). Promotion participants may be required to sign paperwork issued by the Sponsor.
Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent. Administration of this Promotion, including, but not limited to the issuance, delivery, and disbursement of the Promotion Bonus, is at the sole discretion of Sponsor.
As used in these Terms and Conditions, “Promotion Advertisement” means the description of the Promotion presented to the participant at the time immediately prior to entering the Promotion or the code presented to the participant and used to enter the Promotion. The Promotion Advertisement may include, but is not limited to an advertisement on television, radio, podcast, social media, by email or direct communication, a website or web browser, within the Underdog app (whether on Android, iOS, or otherwise), or in any other manner of presentment, regardless of whether other advertisements provide for different Promotion Bonuses. Underdog expressly reserves the right to present different versions of the Promotion to customers in its sole discretion, for any reason whatsoever, including based upon the manner described in the Promotion Advertisement.
For purposes of these Terms and Conditions, Bonus Funds and/or Bonus Entries mean a dollar equivalent available to the customer as a substitute for entry fees into fantasy sports contests. Bonus Funds and/or Bonus Entries are not cash, cash equivalents, or any other tangible or intangible property of the customer unless and until the turnover or playthrough requirements of the Promotion are met.
Promotion Bonus (whether termed “bonus cash,” “bonus funds,” “bonus entries,” or otherwise) may only be used for fantasy contest entries, and cannot be used for prediction picks, which are event contracts offered through Underdog Predict (a registered FCM) or otherwise made available through Underdog.
For entries composed of a mix of prediction event contract futures and fantasy sports contest entries (“Combinations” or “Combo”), the following rules apply to the use of a Promotion Bonus/Bonus Funds/Bonus Entries: The initial fantasy entry fee is funded with the Promotion Bonus/Bonus Funds/Bonus Entries. When the customer instructs a withdrawal of the Promotion Bonus/Bonus Funds/Bonus Entries for purposes of funding the prediction event contract future, Underdog waives the turnover or playthrough requirement for the Promotion Bonus/Bonus Funds/Bonus Entries and makes the Promotion Bonus/Bonus Funds/Bonus Entries immediately withdrawable to the customer’s prediction event contract market account, per the customer’s instruction. In the event that the customer subsequently cancels the fantasy sports contest portion of the combination entry, the customer agrees that the total amount used to fund the combination entry from a Promotion Bonus/Bonus Funds/Bonus Entries will be deposited to the customer’s fantasy account as a Promotion Bonus/Bonus Funds/Bonus Entries and subject to a continued turnover or playthrough requirement (i.e., it must be “played through” at least once in a valid entry before becoming withdrawable as cash). Upon cancellation of the fantasy entry, the customer retains as immediately withdrawable and unrestricted funds any amount from the prediction event contract future in excess of the amount of the Promotion Bonus/Bonus Funds/Bonus Entries used to fund the combination entry.
3. Promotion Period
The Promotion begins and ends as described in the Promotion Advertisement (“Promotion Period”).
4. Eligibility
The Promotion is only open to individuals who (i) are at least 18 years of age (or 19+ in Alabama and Nebraska, 19+ in Colorado for some games, and 21+ in Arizona, Massachusetts, and Virginia); (ii) are physically present in a state where Underdog operates; and (iii) are not enrolled in any U.S. state or Underdog self-exclusion program or on an active cool-off during the Promotion Period. You may only earn one Promotion Bonus in respect of all such Underdog Accounts under this Promotion. Additionally, Underdog reserves the right to refuse or otherwise restrict your eligibility to participate in any promotion, including this Promotion, for any reason, in its sole discretion, including based on your contest patterns or contest history or if you failed to take advantage of any previous promotion in good faith. The invitation to participate in this Promotion is not transferable. If you were not directly invited to participate in this Promotion by the Sponsor, you are not eligible to participate in this Promotion or earn any Promotion Bonus. Duplicate accounts will be flagged and promotional Bonus Funds/Bonus Entries will be forfeited, in addition to other adverse action consistent with the Underdog Terms of Use and other applicable terms.
Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.
Any participant who is found to be ineligible to play on Underdog immediately forfeits any promotional bonus funds/bonus entries, and any other bonus cash, award, or offer associated with the Promotion.
5. Choose Your Offer
When a Play and Get promotion is offered as a selection within a “Choose Your Offer” promotional campaign, customers are limited to selecting one (1) offer. For the avoidance of doubt, if a customer selects the Play and Get promotion, they will not be eligible to receive any of the other choices presented in the Choose Your Offer advertisement. The selection is final and cannot be changed once made.
If a first-time deposit is made without a Choose Your Offer option having been selected, all available offer options will expire and will no longer be available to be selected seven (7) days after the date of the first-time deposit.
Furthermore, when presented as a new user offer, customers are limited to one (1) new user offer. Customers must make their qualifying entry within the time period specified in the Promotion Advertisement. Failure to do so will result in the offer expiring.
6. How to Enter
To enter the Promotion, participants must place an entry on the Site that consists of at least the minimum amount of money required for the entry fee which is conspicuously stated in the Promotion Advertisement during the Promotion Period (“Eligible Entry”). Entries made in an Underdog draft contest are not considered eligible entries for purposes of this promotion.
7. Claiming Promotion Offer
Once the Eligible Entry has been placed, you will receive the Promotion Bonus after the cancellation window for such Eligible Entry closes. The Promotion Bonus will be credited to your Underdog account within one (1) hour after the cancellation window for such Eligible Entry closes. Promotion Bonus recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion Bonus received, regardless of whether the Promotion Bonus, in whole or in part, is used. The Promotion Bonus value may be reported for tax purposes as required by law. Sponsor reserves the right to withhold any winnings, as required by applicable law.
8. Registration Procedures
To qualify for the Promotion, you must have an active Underdog Account (“Account Holders”) and verify your identity to play on the Site. Creating an Underdog Account at Underdogsports.com is free. By submitting your information and creating an Underdog Account, customers will be required to agree to the Underdog Fantasy & Underdog Predict Terms of Use, Privacy Policies and all other applicable terms and conditions, including these Terms and Conditions. If you do not agree to the Underdog Terms of Use and Privacy Policies, you cannot create an Underdog Account or participate in this Promotion.
9. Limitations on Participation
In addition to the Eligibility Requirements in Section 4, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any promotion for any reason, in its sole discretion, including based on your contest patterns or contest history or if you failed to take advantage of any previous promotion in good faith. This Promotion is void where prohibited by law.
10. Order of Funds Used for Entering Contests
The Promotion Bonus is non-withdrawable but any winnings from fantasy contests entered using the Promotion Bonus are immediately withdrawable. When an Underdog Account has both bonus funds and customer-deposited funds, and that account does not have the ability to select the source of funds, bonus funds will be applied to entry fees before customer-deposited funds. For customers who are presented with the option to select either bonus funds or customer-deposited funds to enter a contest, entry fees will be deducted based on the selection made at the time of entry.
11. Restrictions on Withdrawal
The Promotion Bonus awarded for placing a valid Eligible Entry, in compliance with this Promotion, must be played through one time (1x) during the “Turnover Period” (defined below) before any winnings are eligible for withdrawal.
THE PROMOTION BONUS IS FORFEITED IF THE TURNOVER (PLAYTHROUGH) REQUIREMENT IS NOT FULLY MET WITHIN FOURTEEN (14) DAYS OF THE PROMOTION BONUS BEING ISSUED (“TURNOVER PERIOD”). When the Underdog Account contains both customer-deposited funds and the Promotion Bonus, the Promotion Bonus is applied first before customer-deposited funds when entering fantasy contests for the purpose of determining the amount of forfeited funds. Underdog may reclaim the forfeited Promotion Bonus at any time after the fourteen (14) day Turnover Period has ended, without further notice to the customer. Underdog does not waive the right to reclaim promotional bonus funds/entries, by not automatically reclaiming forfeited funds at the end of the fourteen (14) day Turnover Period, or at any time thereafter. Customers must comply with the cancellation section below if they do not plan on meeting the turnover/playthrough requirement to avoid forfeiture of the Promotion Bonus.
The Promotion Bonus is not transferable and cannot be substituted except in the Sponsor’s sole discretion.
12. Cancellation
Should you wish to cancel your participation in this Promotion at any time, please contact customer support at support@underdogsports.com or support@underdogpredict.com. Upon cancellation, you may withdraw any funds you have deposited into your Underdog Account without restriction. However, any Promotion Bonus in your account is non-withdrawable. Sponsor reserves the right to decline to cancel participation in the Promotion in its sole discretion.
13. Gambling Problem

14. Limitation of Liability
Sponsor is not responsible, and shall have no liability, for any errors or omissions in any advertising for the Promotion nor shall the Sponsor be liable for computer, device, or program malfunctions. The Sponsor is not liable for any erroneous issuance of Promotion Bonuses.

General Information
Waiver and Severability of Terms. The failure of Underdog to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by an arbitrator or court of competent jurisdiction to be invalid, the parties nevertheless agree that the arbitrator or court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.
Statute of Limitations. You and Underdog agree that any claims or lawsuits, regardless of form, arising out of or related to the website, app or platform (including the Promotion) or these Terms and Conditions, the Underdog Terms of Use or Privacy Policy must BE FILED within ONE (1) YEAR of the action, omission, event or occurrence giving rise to the claim or suit, after which such claims will be time-barred and prohibited, without regard to any longer period of time which may be provided by any period of limitation or repose by law or statute. This statute of limitations provision does not apply to residents of New Jersey.
Section Titles. The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect.
