PLEASE NOTE THAT YOUR PARTICIPATION IN THE PROMOTION IS SUBJECT TO THE FOLLOWING OFFICIAL RULES. IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT PARTICIPATE IN THE PROMOTION IN ANY MANNER. PARTICIPANTS IN THE PROMOTION MUST REGISTER AND MAINTAIN AN ACCOUNT WITH UNDERDOG. COLLECTIVELY, "UNDERDOG" REFERS TO UNDERDOG SPORTS HOLDINGS, INC., ITS SUBSIDIARIES AND AFFILIATED ENTITIES, INCLUDING, BUT NOT LIMITED TO, UNDERDOG SPORTS, LLC D/B/A UNDERDOG FANTASY.
UNDERDOG PROVIDES AN ONLINE PLATFORM VIA ITS UNDERDOG APP (WHETHER ON ANDROID, IOS, OR OTHERWISE) AND MAY ALSO OFFER THE PLATFORM THROUGH A WEBSITE (COLLECTIVELY, THE "SITE"). PARTICIPANTS IN THE PROMOTION MUST ALSO ACCEPT THE UNDERDOG FANTASY & UNDERDOG PREDICT TERMS OF USE ("TERMS"), WHICH IN TURN INCORPORATE AND APPLY TO THESE OFFICIAL RULES. THESE OFFICIAL RULES GOVERN AND CONTROL THE PROMOTION AND ARE CONSIDERED TO BE PART OF THE TERMS. PLEASE NOTE THAT THESE RULES EXPRESSLY INCORPORATE MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS SET FORTH IN THE TERMS. THE COLLECTION AND PROCESSING OF PERSONAL INFORMATION AS PART OF OR IN CONNECTION WITH PARTICIPATING IN ANY PROMOTION, INCLUDING THIS ONE, ARE SUBJECT TO AND GOVERNED BY THE UNDERDOG PRIVACY POLICIES.

1. Description of Promotion
Welcome to the Rescues promotion (the “Promotion”), where select participants will receive relief in certain situations where an eligible player in a customer’s entry does not return in the second half of an eligible game. Only certain entries that consist of NBA, MLB, WNBA, NFL, and CFB player picks are eligible for rescue. Partial game picks are never eligible for Rescue. Rescues are not eligible for free to play entries.
PROMOTION REWARDS THAT TAKE THE FORM OF BONUS FUNDS OR BONUS ENTRIES ARE NOT EQUIVALENT TO CASH DEPOSITS. Bonus Funds and Bonus Entries are subject to turnover or playthrough requirements, time limitations, and other limitations detailed in these Official Rules.
2. Sponsor
The Promotion is sponsored by Underdog Sports, LLC (“Underdog” or “Sponsor”). The terms "you" or "your" mean the person to whom a Promotion Bonus (defined below) is issued upon satisfaction of the terms and conditions set forth in this Promotion. Redemption of the Promotion is expressly conditioned upon your acceptance of and compliance with these Promotion Official Rules (or “Official Rules”). Promotion participants may be required to sign paperwork issued by the Sponsor.
Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent. Administration of this Promotion, including, but not limited to the issuance, delivery, and disbursement of the Promotion Bonus, is at the sole discretion of Sponsor.
As used in these Official Rules, "Promotion Advertisement" means the description of the Promotion presented to the participant at the time immediately prior to entering the Promotion or the code presented to the participant and used to enter the Promotion. The Promotion Advertisement may include, but is not limited to an advertisement on television, radio, podcast, social media, by email or direct communication, a website or web browser, within the Underdog app (whether on Android, iOS, or otherwise), or in any other manner of presentment, regardless of whether other advertisements provide for different Promotion Bonuses. Underdog expressly reserves the right to present different versions of the Promotion to customers in its sole discretion, for any reason whatsoever, including based upon the manner described in the Promotion Advertisement.
For purposes of these Official Rules, Bonus Funds / Bonus Entries mean a dollar equivalent available to the customer as a substitute for entry fees into fantasy sports contests. Bonus Funds / Bonus Entries are not cash, cash equivalents, or any other tangible or intangible property of the customer unless and until the turnover or playthrough requirements of the Promotion are met.
Promotion Bonus (whether termed "bonus cash," "bonus funds," "bonus entries," or otherwise) may only be used for fantasy contest entries, and cannot be used for prediction picks, which are event contracts offered through Underdog Exchange DCM, Inc. (“Underdog Exchange", a registered DCM); UDM, LLC (“Underdog Predict”, a registered FCM); or UDM Services, LLC or otherwise made available through Underdog.
For entries composed of a mix of prediction event contract futures and fantasy sports contest entries (“Combinations” or “Combo”), the following rules apply to the use of a Promotion Bonus/Bonus Funds/Bonus Entries: The initial fantasy entry fee is funded with the Promotion Bonus/Bonus Funds/Bonus Entries. When the customer instructs a withdrawal of the Promotion Bonus/Bonus Funds/Bonus Entries for purposes of funding the prediction event contract future, Underdog waives the turnover or playthrough requirement for the Promotion Bonus/Bonus Funds/Bonus Entries and makes the Promotion Bonus/Bonus Funds/Bonus Entries immediately withdrawable to the customer’s prediction event contract market account, per the customer’s instruction. In the event that the customer subsequently cancels the fantasy sports contest portion of the combination entry, the customer agrees that the total amount used to fund the combination entry from a Promotion Bonus/Bonus Funds/Bonus Entries will be deposited to the customer’s fantasy account as a Promotion Bonus/Bonus Funds/Bonus Entries and subject to a continued turnover or playthrough requirement (i.e., it must be “played through” at least once in a valid entry before becoming withdrawable as cash). Upon cancellation of the fantasy entry, the customer retains as immediately withdrawable and unrestricted funds any amount from the prediction event contract future in excess of the amount of the Promotion Bonus/Bonus Funds/Bonus Entries used to fund the combination entry.
3. Promotion Period
The Promotion begins and ends as described in the Promotion Advertisement (the "Promotion Period"). Sponsor reserves the right to modify the Promotion Period at any time in its sole discretion.
4. Eligibility
The Promotion is only open to individuals who are: (i) at least 18 years of age (or 19+ in Alabama and Nebraska, 19+ in Colorado for some games, and 21+ in Arizona and Virginia); (ii) physically present in a state where Underdog fantasy contests or event contracts are offered; and (iii) are not enrolled in any U.S. state or Underdog self-exclusion program, on an active cool-off during the Promotion Period, or otherwise unpermitted to enter into contests or transactions on the Underdog platform.
Eligibility may be further limited as set forth in the Promotion Advertisement.
Additionally, Underdog reserves the right to refuse or otherwise restrict your eligibility to participate in any promotion, including this Promotion, for any reason, in its sole discretion, including based on your contest patterns or contest history or if you failed to take advantage of any previous promotion in good faith. Duplicate accounts will be flagged and the Promotion Award will be forfeited, in addition to other adverse action consistent with the Underdog Terms of Use and other applicable terms.
Any questions relating to eligibility, these Official Rules or any other questions concerning this Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.
Any participant who is found to be ineligible to play on Underdog immediately forfeits any promotional bonus funds, and any other bonus cash, award, or offer associated with the Promotion.
Employees, officers, and directors of Underdog or its affiliates, advertising and promotion agencies, and their immediate family members and household members are not eligible to participate in the Promotion.
5. How to Enter
To participate in this Promotion, you must submit a qualifying entry through your Underdog account during the Promotion Period. No additional opt-in is required. Your entry must include one or more eligible player projections and otherwise comply with all applicable Underdog rules and Terms. In Underdog’s sole discretion, certain customers will be automatically considered for Rescue eligibility if their entry meets the applicable conditions set forth below.

6. Claiming Promotion Offer
If an eligible customer (selected at Underdog’s sole discretion) (i) includes an eligible player in such customer’s entry that only plays in the first half of an eligible game but does not return in the second half for an eligible reason (e.g., injury, ejection, etc.); (ii) the customer selected “higher” on that player’s projection; and (iii) the player’s actual performance graded below the projected value, then (a) the customer’s entry will be refunded via cash or bonus funds at Underdog’s sole discretion and (b) the customer will receive a Gimme Pick available in their Underdog account the following day. Gimme Picks are subject to the Gimme Picks Promotion Official Rules. Only valid entries are eligible–i.e., Rescues do not apply to entries where any other selection(s) are graded as losses. Rescues may apply to Flex entries if the entry has at least one losing selection and would otherwise not return a payout. For Streaks, any Rescue will be automatically refunded and the Streak will be settled. Partial game picks are not eligible for Rescue and this Promotion is not available for free to play entries. For Combos, eligible entries are refunded the Fantasy reservation fee if the Prediction entry loses. If the Prediction entry wins, you are refunded the Fantasy reservation fee and paid out for the Prediction entry. Only one Gimme Pick will be issued per uniquely impacted player, regardless of the number of affected entries. 7. Registration Procedures
To qualify for the Promotion, you must have an active Underdog account and verify your identity to play on the Site. Creating an Underdog account on the Site is free. By submitting your information and creating an Underdog account, customers will be required to agree to Underdog’s Terms of Use, Privacy Policies and all other applicable terms and conditions, including these Official Rules. If you do not agree to the Underdog Terms of Use and Privacy Policies, you cannot create an Underdog Account or participate in this Promotion.
8. Limitations on Participation
In addition to the Eligibility Requirements in Section 4, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any promotion for any reason, in its sole discretion, including based on your contest patterns or contest history or if you failed to take advantage of any previous promotion in good faith. This Promotion is void where prohibited by law.
To ensure that the Promotion is limited as intended, Sponsor may permit only one participant from each household address, IP address, email address, payment method, and/or shared device. The use of programs designed to automate gameplay (i.e., "bots") is not permitted. Any participant found to be using such software, using more than one account or username, or otherwise engaging in any fraudulent, suspicious, or illegal activity may be excluded from the Promotion and may forfeit any Promotion Bonus, whether or not the participant would or might have earned any Promotion Bonus but for such activity.
9. Order of Funds Used for Entering Contests
The Promotion Bonus is non-withdrawable but any winnings from fantasy contests entered using the Promotion Bonus are immediately withdrawable. When an Underdog Account has both bonus funds and customer-deposited funds, and that account does not have the ability to select the source of funds, bonus funds will be applied to entry fees before customer-deposited funds. For customers who are presented with the option to select either bonus funds or customer-deposited funds to enter a contest, entry fees will be deducted based on the selection made at the time of entry.
10. Restrictions on Withdrawal
Bonus Funds awarded as a Promotion Reward must be played through one time (1x) during the applicable turnover period before any winnings are eligible for withdrawal. The turnover period for Bonus Funds will be specified in the Promotion Advertisement. If no turnover period is specified, the default turnover period is fourteen (14) days from issuance (“Turnover Period”). Bonus Funds will be forfeited if not used within the Turnover Period. Sponsor may reclaim Bonus Funds at any time after the Turnover Period has ended, without further notice to the customer. Sponsor does not waive the right to reclaim the Promotion Reward if it does not automatically reclaim it at the end of the Turnover Period, or at any time thereafter.
11. Cancellation
Should you wish to cancel your participation in this Promotion at any time, please contact customer support at support@underdogsports.com. Upon cancellation, you may withdraw any funds you have deposited into your Underdog Account, less any Promotion Bonus already used to fund entry fees.. However, any Promotion Bonus in your account is non-withdrawable and will remain subject to their applicable terms (including turnover, playthrough, and expiration requirements). Any Promotion Bonus used to fund entry fees prior to cancellation, including entries placed after a cancellation request, will be deemed funded with your deposited funds and deducted from your cash balance before any withdrawal is processed. Sponsor, in its sole discretion, reserves the right to decline your request to cancel participation in the Promotion.

13. Limitation of Liability
Sponsor is not responsible, and shall have no liability, for any errors or omissions in any advertising for the Promotion nor shall the Sponsor be liable for computer, device, or program malfunctions. The Sponsor is not liable for any erroneous issuance of Promotion Bonuses.
14. Additional Terms for Our California Consumers
Under California Civil Code Section 1789.3, California consumers are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. 15. General Information
Waiver and Severability of Terms. The failure of Underdog to exercise or enforce any right or provision of the Official Rules shall not constitute a waiver of such right or provision. If any provision of the is found by an arbitrator or court of competent jurisdiction to be invalid, the parties nevertheless agree that the arbitrator or court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Official Rules remain in full force and effect.
Statute of Limitations. You and Underdog agree that any claims or lawsuits, regardless of form, arising out of or related to the website, app or platform (including the Promotion) or these Official Rules, the Underdog Terms of Use or Privacy Policy must BE FILED within ONE (1) YEAR of the action, omission, event or occurrence giving rise to the claim or suit, after which such claims will be time-barred and prohibited, without regard to any longer period of time which may be provided by any period of limitation or repose by law or statute. This statute of limitations provision does not apply to residents of New Jersey.
Section Titles. The section titles in the Official Rules are for convenience only and have no legal or contractual effect.
